Welcome to CrackerJack Stadium. These Terms of Service ("Terms") govern your use of our website at crackerjackstadium.com and your purchase of products from our online store (the "Services"). Our store is operated by CrackerJack Stadium, located at 620 Niagara St, Welland, ON L3C 1L8, Canada.

Please read these Terms carefully before using the Services. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, including the Consumer Protection Act, 2002 (Ontario).

About Us

CrackerJack Stadium is a retail store specializing in sports cards, trading card games, collectibles, and related accessories. We operate both a physical retail location and an online store.

Eligibility

You must be at least 18 years of age, or the age of majority in your province or territory of residence, to use the Services and make purchases. By using the Services, you represent that you meet this requirement.

Products and Descriptions

We make every effort to display and describe our products accurately. However, we do not warrant that product descriptions, images, pricing, or other content on the website are complete, accurate, reliable, current, or error-free. Product images are for illustrative purposes and may not exactly represent the actual product. Colours may vary depending on your device display.

For trading cards and collectibles, condition descriptions (such as Near Mint, Lightly Played, or similar designations) reflect our reasonable assessment based on industry standards. Graded cards are assessed by the grading company indicated, and we are not responsible for differences of opinion regarding condition or grade.

Pricing and Payment

All prices are listed in Canadian dollars (CAD) unless otherwise stated. Prices include the listed product price but do not include applicable taxes or shipping charges, which are calculated and displayed at checkout before you complete your purchase.

We reserve the right to change prices at any time without prior notice. However, price changes will not affect orders that have already been confirmed.

Applicable taxes, including HST (Harmonized Sales Tax), will be added to your order as required by law and will be shown at checkout.

We accept payment through the methods displayed at checkout. Payment is processed at the time your order is placed through Shopify Payments or other available payment processors. All payments are processed securely, and we do not store your full payment card details.

Orders and Acceptance

When you place an order through our website, you are making an offer to purchase the products in your cart. We will send you an order confirmation email acknowledging that we have received your order. This confirmation does not constitute acceptance of your order.

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity. If we cancel your order after payment has been processed, we will issue a full refund.

An order is accepted when we ship the product to you or confirm shipment via email. At that point, a binding agreement is formed between you and CrackerJack Stadium.

Ontario Internet Agreement Disclosures

For online purchases by consumers in Ontario with a total payment obligation exceeding $50.00, the following information is provided in accordance with Part III of the Consumer Protection Act, 2002 (Ontario) and Ontario Regulation 17/05:

Your Rights Under the Consumer Protection Act (Ontario)

If you are a consumer in Ontario and your total payment obligation exceeds $50.00 (excluding the cost of borrowing), you may have the right to cancel an internet agreement within 7 days of receiving a copy of the agreement if the supplier did not disclose the information required under the Act before the agreement was entered into. All content on our website, including text, images, logos, graphics, and software, is the property of CrackerJack Stadium or our licensors and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

Product names, brand names, and trademarks displayed on our website belong to their respective owners and are used for identification and descriptive purposes only. CrackerJack Stadium is not affiliated with or endorsed by the manufacturers of the products we sell unless explicitly stated.

Prohibited Uses

You agree not to use our website or Services to: engage in any unlawful or fraudulent activity; attempt to interfere with the proper functioning of the website; use automated systems (bots, scrapers, or similar tools) to access or collect data from the website; submit false or misleading information; or infringe on the rights of others.

Nothing in these Terms excludes or limits any rights you have under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer protection legislation that cannot be excluded or limited by agreement.

Disclaimer of Warranties

Except as expressly provided in these Terms, the Services and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

This disclaimer does not affect any warranties or rights that cannot be excluded under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer protection legislation.

Indemnification

You agree to indemnify and hold harmless CrackerJack Stadium, its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Services, or your infringement of any rights of a third party.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
